Upon receiving your request, we will need to verify your identity to determine you are the same person about whom we have the information in our system. Right to rectification

You have the right to request the rectification of your Personal Information, in order to obtain the modification of your Personal Information if your Personal Information is inaccurate or incomplete.

Right to cancel

You have the right to request the cancellation of your Personal Information, from the files, records and systems of CPC BIOTECH so that they are no longer in its possession, when one of the following conditions applies:

  • you object to the processing of your Personal Information and there are no overriding legitimate reasons justifying our continuing to process your Personal Information (e.g., legal obligation);
  • you decide to withdraw your consent on which the processing is based;
  • your Personal Information is no longer useful for the original purposes for which it was collected;
  • the use that is made of your Personal Information does not comply with the applicable legal or regulatory provisions.

The cancellation of the Personal Information will give rise to a blocking period after which the Personal Information will be deleted, CPC BIOTECH may keep them exclusively for the purposes of the liabilities arising from the processing.

The blocking period will be equivalent to the statute of limitations period of the actions derived from the legal relationship on which the processing is based under the terms of the applicable Law on the matter, and once the data has been cancelled, notice will be given to you.

Right to object

You have the right to object to our processing of your Personal Information at any time and for legitimate reasons or to demand the cessation of such processing when:

I. There is legitimate cause and your specific situation so requires, which must justify that even though the processing is lawful, it must cease in order to prevent its persistence from causing you damage, or

II. Your personal data is subject to automated processing, which produces undesired legal effects or significantly affects your interests, rights or freedoms, and is intended to evaluate, without human intervention, certain personal aspects of the same or to analyze or predict, in particular, your professional performance, economic situation, state of health, sexual preferences, reliability or behaviour.

The exercise of the right to object shall not be applicable in those cases in which the processing is necessary for the fulfilment of a legal obligation imposed on CPC BIOTECH.

You also have the right to limit the use and disclosure of your Personal Information and to withdraw the consent granted for its processing, when the same was needed for the processing. This withdrawal will not affect the lawfulness of the Personal Information processing operations previously carried out.

Under certain circumstances, CPC Biotech may ask you for specific information in order to confirm your identity and ensure the exercise of your rights. This is another appropriate security measures to ensure that Personal Information is not disclosed to an individual who does not have the right to receive it.

i) Your name and address or any other means to receive notifications;

ii) documents proving your identity or, if applicable, the personality and identity of your legal representative;

iii) clear and precise description of the Personal Information with respect to which the exercise of any of the ARCO rights is sought, (except in the case of the right of access);

iv) description of the ARCO right to be exercised, or what you are requesting; and

v) any other element or document that facilitates the location of your Personal Information.

If needed, you may also lodge a complaint with your national data protection authority, i.e., the Secretariat Anticorruption and Good Governance.

ADDITIONAL INFORMATION FOR INDIVIDUALS IN PEOPLE’S REPUBLIC OF CHINA (“PRC”)

A. Purposes and Legal Basis for Processing Personal Information

For PRC residents, we process personal information primarily based on consent, unless processing falls under other statutory legal bases provided by law. Specific exceptions where consent is not required are as follows:

  • Where it is necessary for the conclusion or performance of a contract to which the individual concerned is a party, or for the implementation of human resources management in accordance with the labor rules and regulations formulated in accordance with the law.
  • Where it is necessary for the performance of statutory duties or statutory obligations.
  • Where it is necessary for the response to a public health emergency or for the protection of the life, health and property safety of a natural person in an emergency.
  • Where such acts as news reporting and supervision by public opinions are carried out for the public interest, and the handling of personal information is within a reasonable scope.
  • Where it is necessary to process the personal information disclosed by the individual concerned or other personal information that has been legally disclosed within a reasonable scope in accordance with the provisions of the Personal Information Protection Law of PRC (“PIPL”).

In addition, we will always obtain separate consent for processing sensitive personal information, sharing information with other processors, and transferring personal information outside the PRC.

B. How and when we share Personal Information with Other Processors

Under PIPL, where a personal information processor provides other personal information processors with the personal information of an individual it processes, it shall inform the individual of the name and contact information of the recipient, purpose and method of handling and type of personal information and obtain the individual's separate consent. The recipient shall process personal information within the scope of the above purpose and method of handling and type of personal information. It shall obtain the new consent of the individual in accordance with the PIPL in case of changes in the original purpose and method of handling.

If sharing with other personal information processors is necessary, we will inform individuals and secure their separate consent. For entrusted processing, we will enter into binding agreements to ensure legal compliance.

C. Your Rights over Your Personal Information

If you are a PRC resident, please contact us at info@cpc-bio.cn for any inquiries regarding this privacy policy, or to exercise your rights under this Section. You have the following rights over your personal information:

  • the right to know and make decisions on the processing of your personal information, and right to restrict or refuse others to process your personal information, unless otherwise provided for by laws and administrative regulations of PRC.
  • the right to access or duplicate your personal information from a personal information processor.
  • the right to request the personal information processor to correct or complete your personal information if it is inaccurate or incomplete.
  • the right to request the deletion of your personal information under the circumstances.
  • the right to request a personal information processor to explain its processing rules for personal information.
  • the right to withdraw your consent if the processing of your personal information is based on your consent.

D. Cross-Border Transfer of Personal Information

If you are a PRC resident, any transfer of your personal information outside the territory of the PRC due to business and other needs shall meet one of the following conditions and we will seek your separate consent before such cross-border transfer:

  • we have passed the security assessment organized by the Cyberspace Administration of China (“CAC”).
  • we are certified by specialized agency for protection of personal information in accordance with the provisions of the CAC.
  • we enter into a contract with the overseas recipient under the standard contract formulated by the CAC, specifying the rights and obligations of both parties.

We are committed to ensuring overseas recipients provide equivalent levels of protection in compliance with PRC law.

E. Protection of Minors

We emphasize the importance of protecting minors’ information and make no active effort to collect personal information from children under the age of 18 and do not wish to receive such information.
